Key Stages and Timescales
The time your matter takes depends largely on the stage at which it is resolved. If a settlement is reached during pre-claim conciliation, your case is likely to take between 2 and 16 weeks. If your claim proceeds to a final hearing, it may take between 12 and 24 months, depending on the tribunal's listing availability and the complexity of the matter.
- Initial instruction and document review — Review of contracts, correspondence, and relevant documentation; advice on prospects and strategy.
- Early Conciliation (ACAS) — Mandatory pre-claim conciliation process. Many matters resolve at this stage.
- Claim or Response — Preparation and submission of the ET1 (claimant) or ET3 (respondent) to the Tribunal.
